Terms and Conditions for Sunny
As the owner of Sunny, a 10-bedroom luxury retreat center in Uluwatu, Bali, I have established these Terms and Conditions to govern bookings, payments, cancellations, and guest conduct. These terms incorporate three distinct booking types across two seasons: Group Retreat Bookings and Wellness Stay during Season 1 (May 1 to mid-November), and Hotel Vacay Season during Season 2 (mid-November to May). By making a booking, guests agree to comply with these terms, ensuring a seamless and enjoyable experience while protecting the operational integrity of the retreat center.
1. Booking Types and Seasons
Sunny operates under two seasonal structures with three booking types, each with specific terms and pricing:
1.1 Season 1: May 1 to Mid-November
a) Group Retreat Bookings
Description: Exclusive hire of the entire retreat center for large groups, ideal for wellness retreats, corporate events, or private gatherings.
Availability: Bookings start on Mondays for 5-6 nights.
Pricing: $15,000 USD for the entire retreat space (10 bedrooms, accommodating up to 20 guests), inclusive of 10% tax.
Booking Process: Reservations must be made directly through my team via email or phone. Availability can be checked at [insert booking link].

b) Wellness Stay

2. Booking and Payment Terms
2.1 Deposit
For Group Retreat Bookings and Wellness Stay:
A non-refundable deposit of 30% of the total booking cost is required at the time of reservation to secure the booking.
For Hotel Vacay Season:
Deposits are subject to the terms of Booking.com or Airbnb, typically 30% non-refundable, payable at booking.
The deposit confirms the guest’s commitment and reserves the retreat center or room(s) for the specified dates.
2.2 Final Payment
For Group Retreat Bookings and Wellness Stay:
The remaining balance (70% of the total booking cost) is due 60 days prior to the check-in date.
Payments must be made in USD via bank transfer, credit card, or an approved online payment platform (e.g., PayPal, subject to applicable fees).
For Hotel Vacay Season:
Final payment terms follow the policies of Booking.com or Airbnb, typically due 60 days prior to check-in or as specified on the platform.
If the final payment is not received by the due date, I reserve the right to cancel the booking without refunding the deposit.
2.3 Booking Confirmation
A booking is confirmed only upon receipt of the deposit and written acknowledgment from my team (for Group Retreat Bookings and Wellness Stay) or the booking platform (for Hotel Vacay Season).
Guests will receive a confirmation email detailing the booking dates, total cost, and payment schedule.
3. Cancellation Policy
3.1 Guest Cancellations
Group Retreat Bookings and Wellness Stay:
The 30% deposit is non-refundable under all circumstances.
Cancellations made more than 60 days before the check-in date will not incur additional charges beyond the non-refundable deposit.
Cancellations made within 60 days of the check-in date will result in forfeiture of the full booking amount (deposit and final payment, if paid).
Hotel Vacay Season:
Cancellations are subject to the policies of Booking.com or Airbnb, typically non-refundable within 60 days of check-in.
I recommend guests purchase travel insurance to cover unforeseen circumstances leading to cancellation.
3.2 Cancellations by Sunny
In the unlikely event that I must cancel a booking due to unforeseen circumstances (e.g., force majeure, property damage), I will notify guests immediately and offer:
A full refund of all payments made, or
The option to reschedule for alternative dates, subject to availability.
Sunny will not be liable for additional costs incurred by guests (e.g., travel expenses) due to such cancellations.
4. Check-In and Check-Out
Check-In: Check-in time is 10:00 AM WITA or later, unless otherwise agreed. Early check-in is subject to availability and may incur additional fees.
Check-Out: Check-out time is 12:00 PM WITA. Late check-out is subject to availability and may incur additional fees.
Guests must provide valid identification (e.g., passport) upon check-in for registration, as required by Indonesian regulations.
5. Guest Responsibilities
5.1 Property Care
Guests must treat Sunny and its facilities (e.g., pool, spa, yoga studio) with care and respect.
Any damage to the property or its contents caused by guests will result in additional charges to cover repair or replacement costs.
Smoking is prohibited in all indoor areas. Designated outdoor smoking areas may be provided.
5.2 Maximum Occupancy
Group Retreat Bookings: Maximum 20 guests (2 per bedroom) unless otherwise agreed.
Wellness Stay and Hotel Vacay Season: Maximum 2 guests per booked room, with additional guests subject to my approval and extra charges.
Exceeding the agreed occupancy may result in additional fees or termination of the booking.
5.3 Conduct
Guests must comply with Balinese cultural norms, including respect for local customs (e.g., Nyepi, temple ceremonies).
Noise levels must be kept to a minimum after 10:00 PM to respect neighbors and comply with local regulations.
Illegal activities, including drug use, are strictly prohibited and will result in immediate termination of the booking without refund.
6. Liability and Safety
Guest Safety: Guests use Sunny’s facilities (e.g., pool, spa) at their own risk. I recommend supervision of children near water features and adherence to safety guidelines posted on-site.
Liability: Sunny, its staff, and I are not liable for personal injury, loss, or damage to guests’ belongings, except in cases of gross negligence by my team.
Insurance: Guests are strongly encouraged to obtain travel and medical insurance to cover accidents, injuries, or loss during their stay.
Security: While Sunny employs security measures (e.g., CCTV, staff), guests are responsible for securing personal valuables.
7. Force Majeure
I am not liable for failure to perform obligations under these terms due to events beyond my control, including but not limited to natural disasters, government restrictions, pandemics, or power outages.
In such cases, I will work with guests to reschedule bookings or provide refunds as outlined in Section 3.2.
8. Local Regulations and Compliance
Sunny operates in compliance with Indonesian laws, including tourism and building regulations (e.g., SLF and PBG certifications).
Guests must adhere to local laws, including visa requirements and restrictions on foreign visitors in Indonesia.
I reserve the right to terminate bookings without refund if guests violate local laws or regulations.
9. Retreat-Specific Terms
Wellness Activities (Wellness Stay):
Pilates sessions and breakfast are included in Wellness Stay bookings. Additional wellness activities (e.g., spa treatments, yoga) are subject to extra fees and availability.
Participation in wellness activities is at the guest’s own risk, and I recommend consulting a medical professional before engaging in physical activities.
Event Hosting (Group Retreat Bookings):
Events (e.g., retreats, weddings) require prior approval and additional terms regarding capacity, noise, and setup, to be agreed in writing.
Event bookings may incur additional fees for setup, cleaning, or staffing.
Dietary Requirements:
Special dietary requests (e.g., vegan, gluten-free) must be communicated at least 14 days prior to check-in and may incur additional costs.
Dietary inclusions are guaranteed only for Group Retreat Bookings and Wellness Stay, subject to prior arrangement.
10. Modifications to Terms
I reserve the right to modify these Terms and Conditions at any time. Updated terms will be communicated to guests with confirmed bookings and will apply to new bookings.
Any disputes arising from these terms will be resolved under Indonesian law, with jurisdiction in Bali.
